These Terms of Service ("Terms") set out the basis on which BoostCo Remaps Limited, trading as BoostCo Remapping Equipment, registered in Ireland under company number 774534 ("we", "us", "our"), provides this store and website, and all related content, features, tools, products and services (the "Services").
Please read them carefully. They include important provisions about the suitability and lawful use of tuning files, disclaimers of warranty and limitations of our liability.
By visiting, interacting with or using the Services, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, each of which forms part of these Terms. If you do not agree to them, you should not use the Services.
Nothing in these Terms limits or excludes any right you have as a consumer under Irish or European Union law that cannot lawfully be limited or excluded.
1. Access and Account
By agreeing to these Terms you confirm that you are at least the age of majority in your country of residence and have legal capacity to enter into a contract.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Tell us promptly at support@boostco.eu if you believe your account has been accessed without your authorisation.
We may refuse service, close accounts, or cancel orders at our discretion, in particular where we reasonably believe a request is unlawful, fraudulent, or contrary to these Terms.
2. What We Sell
We supply three distinct kinds of product, and different terms apply to each:
- Tuning files and remapping services — bespoke digital content prepared for a specific vehicle and ECU and delivered electronically.
- Hardware — tuning tools, interfaces and related physical goods.
- Credits and redeem codes — prepaid entitlements exchanged for files or services.
We have made every effort to describe our products accurately. Product appearance on screen may vary with your device. Descriptions and specifications may change without notice, and we may discontinue any product or limit quantities at our discretion.
3. Tuning Files: Your Responsibilities
A tuning file is prepared from information you give us. Its suitability depends entirely on that information being correct, so you agree that:
- You own the vehicle or are authorised by its owner to have it modified.
- The vehicle, engine, ECU, hardware and software details you supply are accurate and complete.
- You will read and retain an unmodified backup of the original ECU file before writing any file we supply.
- You will use appropriate, functioning tools and ensure a stable power supply throughout the write process.
- You have the competence to carry out the work, or will have it carried out by a suitably qualified technician.
Writing to an ECU carries inherent risk. An interrupted write, an unstable power supply, unsuitable equipment or incorrect vehicle information can damage or disable an ECU. We are not able to control or supervise the installation process, and we are not responsible for damage arising from it.
Modifying engine management software may invalidate your manufacturer's warranty, and may need to be disclosed to your insurer. Both are your responsibility.
4. Road Legality and Emissions Equipment
Some files we supply alter or disable emissions control equipment, including but not limited to diesel particulate filters (DPF), exhaust gas recirculation (EGR), AdBlue and selective catalytic reduction systems, and diagnostic trouble code reporting associated with them.
Vehicles using such files are not permitted on public roads in Ireland, the European Union or the United Kingdom. They are supplied strictly for off-road, motorsport, competition, export or research use, and only where such use is lawful in the relevant jurisdiction.
By ordering such a file you confirm that you will use it only for those purposes, and you accept sole responsibility for compliance with all applicable law. Use on a public road may render the vehicle non-compliant with roadworthiness testing (including the NCT and CVRT in Ireland), may invalidate insurance, and may constitute an offence.
We do not advise on whether a particular modification is lawful in your jurisdiction. If you are unsure, seek independent advice before ordering.
5. Credits and Redeem Codes
Credits and redeem codes are entitlements to obtain files or services from us. They have no cash value, are not transferable unless we agree in writing, and cannot be exchanged for money.
Redeeming a code is the point at which the associated file or service is supplied. Refund treatment of redeemed and unredeemed codes is set out in our Refund Policy.
You are responsible for keeping codes secure. We are not liable for codes redeemed by someone who obtained them from you, whether or not with your knowledge.
6. Orders, Prices and Payment
Your order is an offer to buy. A contract is formed when we accept it, which we may do expressly or by beginning to prepare or dispatch your order.
Prices are shown in the currency indicated at checkout and may change without notice, though changes do not affect orders already accepted. We may correct pricing or description errors and cancel affected orders, refunding any sum paid.
You confirm that any payment method you use is yours or that you are authorised to use it.
7. Supply of Digital Content
Tuning files are digital content supplied electronically. Where you consent to immediate supply, work begins straight away and your right to cancel ends at that point, as explained in our Refund Policy.
Turnaround times quoted anywhere on the Services are indicative. Most files are returned quickly, but complex or unusual requests may take longer.
8. Shipping and Delivery of Hardware
Delivery estimates are estimates, not guarantees. Risk in physical goods passes to you on delivery. We are not responsible for delays caused by carriers, customs or events outside our reasonable control.
Import duties and taxes on shipments outside Ireland are your responsibility.
9. Cancellation and Refunds
Your cancellation and refund rights, including the statutory cooling-off period and our guarantee on tuning files, are set out in full in our Refund Policy, which forms part of these Terms.
10. Intellectual Property and Licence
All content on the Services — text, graphics, logos, software, file structures and data — belongs to us or our licensors and is protected by intellectual property law.
A tuning file is licensed to you, not sold. You receive a non-exclusive, non-transferable licence to use it on the single vehicle it was prepared for. You may not copy, resell, redistribute, publish, sublicense or reverse engineer any file we supply, or use it on any other vehicle.
Breach of this section entitles us to terminate your licence and your account immediately, without refund.
11. Optional Tools and Third-Party Links
We may give access to third-party tools which we neither control nor monitor. They are provided "as is" and "as available", without warranties of any kind. Any use is at your own risk, subject to the third party's own terms.
Links to third-party sites are provided for convenience. We are not responsible for their content, accuracy, products or practices, and their inclusion is not an endorsement.
12. Relationship with Shopify
The Services are hosted by Shopify, which provides the platform enabling us to sell to you. Information you submit is transmitted to and shared with Shopify, and may be processed in countries other than your own, as described in our Privacy Policy.
13. Privacy
Our Privacy Policy explains how we collect, use and disclose your personal information, and forms part of these Terms.
14. Feedback
If you send us ideas, suggestions or other feedback, we may use them without restriction or obligation to you. Please do not send confidential information you do not wish us to use.
15. Errors, Inaccuracies and Omissions
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, availability or turnaround times. We may correct these and update information at any time without prior notice.
16. Prohibited Uses
You may use the Services for lawful purposes only. You may not:
- use the Services for any unlawful, fraudulent or malicious purpose;
- supply false vehicle, ownership or contact information;
- resell, redistribute or share any tuning file supplied to you, or use it on a vehicle other than the one it was prepared for;
- attempt to reverse engineer, decompile or extract the methods behind our files or tools;
- infringe our intellectual property rights or those of anyone else;
- harass, abuse, threaten or defame our staff or any other person;
- upload viruses or any code intended to disrupt or damage the Services;
- attempt to gain unauthorised access to the Services, other accounts, or connected systems;
- interfere with the security or proper operation of the Services.
We may terminate access immediately for breach of this section.
17. Termination
These Terms remain in effect while you use the Services. You may stop using them at any time. We may suspend or terminate your access where you breach these Terms, or where we reasonably suspect unlawful use. Provisions which by their nature should survive termination will do so.
18. Disclaimer of Warranties
Except as expressly stated in these Terms or our Refund Policy, and except for rights you have as a consumer which cannot lawfully be excluded, the Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied.
We do not warrant that the Services will be uninterrupted, error-free or secure, or that any particular performance result will be achieved by any tuning file on any vehicle. Vehicles differ in condition, specification, fuel quality and maintenance history, and outcomes vary accordingly.
If you are a consumer, your statutory rights are not affected by this section.
19. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to that, we are not liable for:
- damage to a vehicle, ECU or component arising from installation, whether carried out by you or a third party;
- loss arising from inaccurate information supplied to us;
- loss arising from use of a file contrary to section 4;
- indirect or consequential loss, loss of profit, loss of use, or loss of business.
Subject to the first paragraph of this section, our total liability arising out of or in connection with any order will not exceed the amount you paid for that order.
If you are a consumer, this section does not affect your statutory rights.
20. Indemnification
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your use of a file contrary to section 4, or your supply of inaccurate information.
21. General
If any provision is found unenforceable, the remainder continues in force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies referenced in them, form the entire agreement between us. You may not assign your rights without our written consent; we may assign ours on notice to you.
22. Governing Law and Jurisdiction
These Terms and any dispute arising out of them are governed by the laws of Ireland, and are subject to the jurisdiction of the courts of Ireland.
If you are a consumer resident in another European Union member state, you benefit from the mandatory protections of the law of your country of residence, and you may also bring proceedings in the courts of that country.
23. Changes to These Terms
We may update these Terms from time to time. The current version is always available on this page, and the "Last updated" date shows when it last changed. Continued use of the Services after a change means you accept the updated Terms.
